Terms and Conditions

Thank you for choosing Ferguson Valley Escape for your holiday stay or special occasion.

These booking terms and conditions set out the framework for deposits, payments, cancellation and rescheduling, and related obligations. By paying the deposit and/or any progress payment, you confirm acceptance of these terms.

Booking Terms & Conditions

1. Definitions and Interpretation

1. “Ferguson Valley Escape”means the property and associated services provided by Ferguson Valley Escape, as confirmed in your booking documentation.

2. “Guest”, “you”, or “your” means the person(s), group, or organisation making the booking and any person attending on that booking.

3. “Booking”means the confirmed reservation for accommodation and/or use of facilities and/or any included services for the stated dates and purpose.

4. “Event” includes any function, celebration, retreat, corporate booking, or gathering associated with the Booking.

5. “Deposit”means the amount required at the time of booking to secure the Booking.

6. “Progress Payments”means payments required at agreed intervals leading up to the Booking date.

7. “Final Balance”means the remaining amount payable prior to the Booking start date as specified in the booking confirmation.

8. “Confirmed Dates” are the dates stated in the written booking confirmation and/or invoice.

Securing Your Booking

1. A Booking is only secured when:

• Ferguson Valley Escape has issued a booking confirmation and/or tax invoice reflecting the confirmed dates.

• You have paid the Deposit (and any other required/arranged progress payments)

2. Group and special occasion bookings are frequently made far in advance, and dates are held exclusively for your Booking once confirmed.

3. The Deposit is strictly non-refundable and constitutes your express acceptance of these terms and conditions.

4. Payments (Deposit and Progress Payments)

5. You must make all payments on or before the due dates shown in your booking confirmation and/or invoice.

6. Progress Payments are required at the agreed intervals leading up to the Booking date.

7. All payments made (including the Deposit) are strictly non-refundablebecause they:

• secure the dates for your Booking, cover administration costs and,

• reserve the period against alternative bookings, thus block out other bookings.

8. If any required payment is not made by its due date, Ferguson Valley Escape may cancel the Booking in accordance with these terms.

9. Unless Ferguson Valley Escape expressly agrees otherwise in writing, payments and date changes are not transferrable to another booking date as this causes loss of income, so once your date is secured, its set. Only in the instance that by mutual agreement, the dates can be refilled at the same or greater value can we offer a reschedule arrangement.

Cancellation by the Guest

1. If you need to cancel or reschedule, you must notify Ferguson Valley Escape as soon as possible in writing (including email or other written form)

2. Because the confirmed Booking dates are reserved exclusively for your Booking and may not be replacable at short notice, cancellation causes significant loss of income and related costs.

3. Cancellation within six (6) months of the Booking start date:

• you will be liable for the full booking cost (being the total charges for the confirmed dates and inclusions).

4. Cancellation more than six (6) months before the Booking start date:

• Ferguson Valley Escape will retain 50% of the Deposit and progress payments received for that Booking at the time of cancellation, for loss of income/business.

6. Payments already received will be applied toward:

• administration costs, and

• covering income loss and other direct costs incurred in reliance on the Booking.

Rescheduling (By Request of the Guest)

1. Should you request a reschedule to alternative dates by written notice to Ferguson Valley Escape;

2. Rescheduling is subject to availability and is at Ferguson Valley Escape’s discretion and only granted should the dates be rebooked by another party for the same or greater value.

3. If Ferguson Valley Escape is able to secure another booking for the cancelled dates at the same or greater value, Ferguson Valley Escape may (at its discretion) offer to reschedule your Booking to an alternative date within twelve (12) months of the original Booking start date.

4. Rescheduling is not automatic and provides no entitlement to a refund.

5. Where rescheduling is approved:

• any changes in price arising from seasonal rates, revised service levels, or updated inclusions may be payable by you, and

• Ferguson Valley Escape may recalculate costs based on the new dates and arrangements.

6. If rescheduling is not possible or not approved, the cancellation terms in these conditions will apply.

Final Balance and Non-Payment Consequences

1. The Final Balance must be paid in full by the month before due date stated in your booking confirmation and/or invoice.

2. If the Final Balance is not received by the due date:

• Ferguson Valley Escape may cancel the Booking, and

• all monies paid will be forfeited in accordance with these terms.

3. Ferguson Valley Escape is not liable for any losses you may suffer resulting from cancellation due to non-payment of the Final Balance.

7. Guest Numbers, Scope, and Changes

1. Any changes to the Booking (including date changes, accommodation configuration, catering scope, or the purpose/type of event) must be agreed in writing by Ferguson Valley Escape.

2. Headcount and inclusions may directly affect pricing. Where headcount changes, Ferguson Valley Escape may revise pricing to reflect the revised scope and decrease in numbers do not warrant a refund.

3. Late changes may not be accommodated where services have already been scheduled, confirmed, or purchased.

Accommodation, Facilities, and Conduct

1. You agree to use the premises and facilities lawfully and in accordance with onsite directions issued by Ferguson Valley Escape Policies and procedures.

2. You are responsible for ensuring your attendees comply with onsite rules relating to safety, noise, conduct, and any other operational requirements communicated to you prior to or during the Booking.

3. Damage beyond fair wear and tear caused by you, your guests, contractors, or invitees may result in additional charges.

4. Ferguson Valley Escape may require removal of persons whose conduct breaches these terms or onsite directions. No refund will be provided for any unused portion of the Booking.

Force Majeure (Events Outside Reasonable Control)

1. Ferguson Valley Escape is not liable for failure or delay in performance caused by events outside its reasonable control, including extreme weather, natural disasters, supply interruptions, government restrictions, or other comparable circumstances.

2. Where force majeure occurs, Ferguson Valley Escape may:

• propose alternative arrangements and/or dates,

• adjust services as reasonably necessary, and/or

• cancel the Booking where continuation is not reasonably possible.

3. Where cancellation occurs due to force majeure, monies already received are dealt with in accordance with these terms and the specific circumstances, unless Ferguson Valley Escape agrees otherwise in writing.

Event Compliance

1. You must ensure all attendees comply with applicable laws and any onsite safety instructions.

2. You must not do anything that creates danger, fire, nuisance, or risk to persons or property.

3. Ferguson Valley Escape may impose reasonable restrictions on activities where required for safety or operational reasons such as fire bans in fire ban season.

Acknowledgement and Acceptance

1. By paying the Deposit and/or Progress Payments, you confirm that you:

• have read, understood, and accepted these Booking Terms and Conditions, and

• agree to be bound by them.

2. These Booking Terms and Conditions form part of the contractual arrangement between you and Ferguson Valley Escape.

Notice and Communication

1. Notices relating to cancellation, rescheduling, or disputes must be provided in writing to Ferguson Valley Escape (for example via email or another written channel nominated in your booking correspondence).

2. A notice is deemed received when Ferguson Valley Escape acknowledges receipt in writing, unless your booking confirmation states otherwise.

Entire Agreement and Variations

1. These terms constitute the entire agreement regarding bookings with Ferguson Valley Escape to the extent of their subject matter.

2. Any variation must be recorded in writing and accepted by Ferguson Valley Escape.

Promotional Offers and Special Pricing

1. Any promotional offers, discounted pricing, or special packages are subject to these terms unless otherwise expressly stated in the booking confirmation or invoice.

2. Where a promotion includes additional conditions, those conditions will be set out in the booking documentation.
